The terms and conditions set out below, along with any policies we link to within them (these "Terms of Service" or "Terms"), explain the rights and responsibilities that apply when you use the Services.
We ask that you read these Terms of Service closely. They contain important details about your legal rights, including sections that disclaim warranties and limit our liability. Nothing in these Terms affects your statutory rights as a consumer under UK law.
When you visit, interact with, or use our Services, you accept these Terms of Service and our Privacy Policy. If you are not willing to accept them, please do not use or access the Services.
Section 1 — Access and Account
By accepting these Terms of Service, you confirm that you are at least 18 years old (or the age of majority in your country of residence), and that you consent to any minors in your care using the Services on devices you own, buy, or manage.
To use the Services — whether you are browsing our online store or buying a product — we may ask you for certain details, such as your email address and your billing, payment, and shipping information. You confirm that everything you give us is accurate, current, and complete, and that you have the right to share it.
Keeping your account login details secure is your responsibility, as is everything that happens under your account. You may not hand over, sell, assign, or license your account to anyone else.
Section 2 — Our Products
We work hard to show our products and services as accurately as possible across our online store. Even so, the colours and overall look of an item may differ from what you see on your screen, depending on the device you use and how it is set up.
We cannot promise that the look or quality of anything you buy will match your expectations or appear exactly as shown in our store.
Product descriptions may be revised at any time, at our discretion and without notice. We may also stop offering a product whenever we choose, and we may set limits on the quantities we make available to any individual, region, or jurisdiction on a case-by-case basis.
Section 3 — Orders
Placing an order counts as an offer from you to purchase. We may accept or decline any order at our discretion, and your order is only confirmed once we accept it. Before that happens, we need to receive and process your payment. Please look over your order carefully before you submit it. If we decline, change, or cancel an order, we will try to reach you using the email, billing address, or phone number you provided when ordering. This does not affect any statutory right you may have to cancel your order under UK consumer law (see our Return & Refund Policy).
Returns, exchanges, and cancellations are handled in accordance with our Return & Refund Policy and your statutory rights.
You confirm that anything you buy is for your own personal or household use, and not for resale or export.
Section 4 — Prices and Billing
Prices, discounts, and promotions may change at any time without notice. The price you pay is the one in effect when you place your order, and it will be shown in your order confirmation email. Prices are listed in GBP (£). Unless we say otherwise, listed prices may not include delivery, or any customs or import charges that apply to orders shipped outside the UK.
Prices in our online store may not match those found in physical shops or in stores run by third parties. From time to time we may run promotions that affect pricing and that carry their own separate terms. If those promotional terms ever conflict with these Terms, the promotional terms take priority.
You agree to give us accurate, complete, and current purchase, payment, and account information for every order, and to update it promptly — including your email address, card numbers, and expiry dates — so we can process your transactions and reach you when needed.
You confirm that: (i) the payment card details you provide are true and accurate; (ii) you are authorised to use that card; (iii) the charges will be honoured by your card provider; and (iv) you will pay the amounts owed at the listed prices, including delivery and any applicable taxes.
Section 5 — Shipping and Delivery
Any delivery timeframe we share is an estimate only. While we will do our best to meet it, we are not responsible for delays caused by carriers, customs, or other events beyond our reasonable control. Risk of loss or damage to a product passes to you once it is delivered to you or to someone you have nominated to receive it. This does not affect your statutory rights where goods arrive damaged or faulty.
Section 6 — Intellectual Property
Our Services — including all trademarks, brand elements, text, displays, images, graphics, product reviews, video, and audio, as well as the way these are designed, selected, and arranged — belong to Marlow & Grace Boutique, our affiliates, or our licensors, and are protected by copyright, trade mark, and other intellectual property laws.
These Terms allow you to use the Services only for your own personal, non-commercial purposes. Without our prior written permission, you may not copy, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any material from the Services. Nothing in these Terms grants you any licence or rights to any patent, trade mark, copyright, or other intellectual property of Marlow & Grace Boutique, Shopify, or any third party, except where we expressly say so. Using the Services in unauthorised ways may breach intellectual property laws, and all rights we do not expressly grant here remain ours.
The Marlow & Grace Boutique name, logos, designs, slogans, and product or service names are trademarks of Marlow & Grace Boutique or its affiliates or licensors, and you may not use them without our written permission. Shopify's name, logo, and related marks belong to Shopify. Any other names, logos, or marks appearing in the Services belong to their respective owners.
Section 7 — Optional Tools
You may be given access to tools from third parties through the Services — tools that we do not monitor, control, or influence.
We provide access to these tools "as is" and "as available," without any warranties, representations, conditions, or endorsements of any kind, and we accept no liability connected to your use of them, except to the extent such liability cannot be excluded under applicable law.
Using any optional third-party tool is entirely your own choice and at your own risk. Before you do, make sure you have read and agree to the terms set by whoever provides that tool.
If we add new features or tools to the Services in the future, those additions will also count as part of the Services and will be covered by these Terms.
Section 8 — Third-Party Links
The Services may include content and links pointing to websites run by third parties, including embedded third-party features. We are not responsible for reviewing or vouching for the content or accuracy of any third-party material or site. If you choose to leave our Services and visit those sites, you do so at your own risk.
We are not liable for any harm or loss tied to your visit to third-party websites or to anything you buy or use there. Read each third party's policies carefully before entering into any transaction with them. Any complaints, questions, or claims about third-party products and services should be taken up directly with that third party.
Section 9 — Relationship with Shopify
Marlow & Grace Boutique runs on Shopify, which gives us the platform to provide the Services. That said, every sale and purchase in our store is made directly with Marlow & Grace Boutique. By using the Services, you acknowledge that Shopify has no responsibility for any part of a sale between you and us, including any injury, damage, or loss arising from the products or services you buy. You release Shopify and its affiliates from any claims, damages, or liabilities connected to your purchases and dealings with Marlow & Grace Boutique, except where such release is not permitted by law.
Section 10 — Privacy Policy
Any personal information we gather through the Services is governed by our Privacy Policy, and some of it may also fall under Shopify's Privacy Policy. By using the Services, you confirm that you have read both.
Because Shopify hosts the Services, it collects and processes information about how you access and use them in order to deliver and improve them. Information you provide may be transmitted to and shared with Shopify, as well as with partners who may be located in countries other than your own, so that the Services can be delivered to you. Section 11 — Feedback
If you send us any ideas, suggestions, reviews, proposals, plans, or other content (together, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display that Feedback in any medium and for any purpose, including commercial use. For example, we may use this licence to run, provide, evaluate, improve, and promote the Services and to carry out our rights and duties under these Terms.
You also confirm that: (1) you own or hold all rights needed to share the Feedback; (2) you have disclosed any payment or incentive you received in connection with it; and (3) the Feedback complies with these Terms. We are not obligated to keep your Feedback confidential, to pay you for it, or to respond to it.
We may — but are not required to — monitor, edit, or remove any Feedback that we decide, at our discretion, is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes anyone's rights or breaches these Terms.
You agree that your Feedback will not infringe any third party's rights, including copyright, trade mark, privacy, or personality rights, and that it will not be defamatory, abusive, obscene, or otherwise unlawful, nor contain any virus or malware that could affect the Services. You may not use a false email address, pose as someone else, or otherwise mislead us or others about where your Feedback came from. You alone are responsible for your Feedback and its accuracy, and we accept no responsibility or liability for Feedback posted by you or anyone else.
Section 12 — Errors, Inaccuracies, and Omissions
From time to time, content in the Services may contain typos, inaccuracies, or omissions relating to descriptions, pricing, promotions, delivery charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information — or cancel an order — whenever information turns out to be inaccurate, at any time and without prior notice, even after you have placed your order. Where we cancel an order you have already paid for because of an error, we will refund you in full.
Section 13 — Prohibited Uses
You may use the Services only for lawful purposes. You agree not to use the Services, directly or indirectly: (a) for any unlawful or harmful purpose; (b) to break any applicable laws, rules, or regulations; (c) to infringe our intellectual property rights or anyone else's; (d) to harass, abuse, insult, defame, intimidate, or harm our staff or any other person; (e) to share false or misleading information; (f) to upload or reuse any material that does not comply with these Terms; (g) to send any unsolicited advertising, junk mail, chain letters, or spam; (h) to impersonate any person or entity; or (i) to do anything else that restricts others' use of the Services or that we judge may harm Marlow & Grace Boutique, Shopify, or other users, or expose them to liability.
You also agree not to: (a) upload or transmit viruses or other malicious code that could affect how the Services work; (b) reproduce, duplicate, copy, sell, resell, or exploit any part of the Services; (c) collect or track other people's personal information; (d) spam, phish, pharm, pretext, spider, crawl, or scrape; or (e) interfere with or bypass the security features of the Services, related websites, or the internet. We may suspend, disable, or terminate your account at any time, without notice, if we find that you have breached any part of these Terms.
Section 14 — Termination
We may end this agreement or your access to the Services (in whole or in part) at our discretion, at any time and without notice. You will still be responsible for any amounts owed up to and including the date your access ends.
The following sections continue to apply after any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.
Section 15 — Disclaimer of Warranties
The information shared through the Services is provided for general informational purposes only. We do not warrant that it is accurate, complete, or useful, and any reliance you place on it is at your own risk.
Except where we expressly state otherwise, and except for any warranties or guarantees that cannot be excluded under UK law, the Services and all products offered through them are provided "as is" and "as available," without any representation, warranty, or condition of any kind, whether express or implied. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. Nothing in this section limits the statutory rights you have as a consumer, including your rights under the Consumer Rights Act 2015 that goods will be of satisfactory quality, fit for purpose, and as described.
Section 16 — Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law — including your statutory rights as a consumer.
Subject to the paragraph above, and to the fullest extent the law allows, neither Marlow & Grace Boutique — nor our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors, nor those of Shopify and its affiliates — will be liable for any indirect, incidental, special, or consequential loss, or for any loss of profit, revenue, savings, or data, arising from your use of the Services or any product obtained through them, even if we have been advised that such loss was possible.
Section 17 — Indemnification
You agree to indemnify, defend, and hold harmless Marlow & Grace Boutique, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable legal fees — owed to any third party and arising out of: (1) your breach of these Terms of Service or any documents they incorporate; (2) your violation of any law or any third party's rights; or (3) your access to and use of the Services.
We will let you know about any claim covered by this section, though a delay in notifying you will not release you from your obligations unless it genuinely prejudices you. We may take control of the defence and settlement of such a claim at your expense, including choosing legal counsel, but we will not agree to any settlement that places non-monetary obligations on you without your consent, which you will not unreasonably withhold. You agree to cooperate in defending these claims, including by sharing relevant documents.
Section 18 — Severability
If any part of these Terms of Service is found to be unlawful, void, or unenforceable, that part will still be enforced to the fullest extent the law allows, and the unenforceable portion will be treated as separated from the rest. This will not affect the validity or enforceability of any remaining provisions.
Section 19 — Waiver; Entire Agreement
If we do not exercise or enforce any right or provision of these Terms of Service, that does not mean we have waived it.
These Terms of Service, together with any policies or operating rules we post on this site or about the Services, make up the entire agreement between you and us and govern your use of the Services. They replace any earlier agreements, communications, or proposals between us, whether spoken or written, including any previous versions of these Terms. This does not exclude liability for any statement made fraudulently.
Section 20 — Assignment
You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written permission, and any attempt to do so will be void. We may transfer, assign, or delegate these Terms and our rights and obligations, provided this does not reduce the rights you have as a consumer.
Section 21 — Governing Law
These Terms of Service, and any separate agreements through which we provide you the Services, are governed by and interpreted in accordance with the laws of England and Wales. You and Marlow & Grace Boutique agree that the courts of England and Wales will have jurisdiction over any dispute. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the UK where you live.
Note for you to confirm: This assumes your business is based in England or Wales. If you are based in Scotland or Northern Ireland, change "England and Wales" above to your jurisdiction (e.g. "Scotland" / "the laws of Scotland").

The headings in this agreement are there for convenience only and do not limit or otherwise affect these Terms.

You can review the most up-to-date version of these Terms of Service on this page at any time.
We reserve the right, at our discretion, to update, change, or replace any part of these Terms by posting the revised version on our website. It is your responsibility to check the page from time to time. We will notify you of material changes as required by law, and those changes take effect on the date stated in the notice. By continuing to use or access the Services after changes are posted, you accept the updated Terms.
